Judge Rules CitiMortgage Can't Foreclose on South Valley Family

Joey and Lisa Gallegos have lived in their home in deep South Valley for over 25 years, raising their children there. When they got behind on their mortgage payments to CitiMortgage after a job loss, the company filed for foreclosure on the home. The documents CitiMortgage filed in the court case showed that although the company had been collecting payments from the Gallegos family for 20 years, CitiMortgage never actually had possession of their loan documents because the documents were lost by the original lender. New Mexico Legal Aid filed a motion for a ruling that the company could not legally foreclose on the home, and in August 2019, the Judge granted the motion and dismissed the foreclosure. CitiMortgage did not appeal the decision.
